Nanindigan ang mga mahistrado ng Sandiganbayan na itutuloy nila ang pagdinig sa mga kaso nina dating Bureau of Immigration (BI) deputy commissioners Michael Robles at Al Argosino.
Batay sa resolusyon ng 6th Division na may petsang February 28, ibinasura ng anti-graft court ang mosyon ng dalawang akusado hinggil sa kaso.
Iginiit ng korte na hindi maaaring idawit sa kaso ang kawani ng Security and Sheriff Services na si Henry Villanueva dahil maituturing ng nasa kustodiya ng batas ang former BI officials nang isuko nila noong nakaraang taon ang isang cellphone video kung saan pinagbabawalan daw sila nito na lumabas ng korte matapos maghain ng hiling para makapag-piyansa.
“Mr. Henry Villanueva of the Security and Sheriff Services could not be faulted for not allowing accused Argosino and Robles to leave the premises prior to the approval of their bail bonds because he was merely performing his official functions.”
Pinuna rin ng nina Division chairperson Assoc. Justice Sarah Jane Fernandez, at mga miyembrong sina Assoc. Justices Karl Miranda at Zaldy Trespeses ang alegasyong may pinapanigan sila sa kanilang desisyon.
“If accused Argosino believes that this court erroneously ruled on his motions, he is not without remedy because it is his right to, and he may, as held in Webb, avail of the appropriate remedies under the Rules of Court.”
Nahaharap sa mga kasong plunder, graft at direct bribery ang dalawa matapos umanong pumayag na palayain ang higit 1,000 Chinese workers noong 2016 kapalit ng P50-milyong suhol mula sa negosyanteng si Jack Lam.
