CAGAYAN DE ORO CITY – Binigyan na ng Securities and Exchange Commission (SEC) ng kapangyarihan ang local government units (LGUs), kasama ang pulisya at National Bureau of Investigation (NBI) para ipatupad ang cease and desist order laban sa Kabus Padatoon (KAPA) Community International Ministry, Inc.
Sa panayam ng Bombo Radyo sinabi ni SEC regional director Atty. Reynato Egypto na nakatakda na nilang ilabas ang kopya ng en banc resolution na magbibigay ng deputization powers sa mga tanggapan para magpatupad ng kautusan laban sa KAPA.
Ito’y matapos mabatid na patuloy pa rin ang pagtanggap ng grupo ng donasyon mula sa kanilang mga miyembro sa kabila nang pagpapahinto ng SEC.
Ani Egypto, hindi totoo ang kumakalat online na may temporary restraining order na inilabas ang korte para maharang ang implementasyon ng cease and desist order laban sa grupo ni Pastor Joel Apolinario.
Nitong nakaraang Pebrero nang ilabas ng SEC ang kautusan matapos umalma ang ilang miyembro ng KAPA dahil sa umano’y iligal na gawain ng grupo.
“RESOLVED, To APPROVE, the Deputization of Local Government Units (LGUs), Philippine National (PNP), and National Bureau of Investigation (NBI) to assist the Commission in Enforcing its Cease and Desist Order (CDO) dated 14 February 2019 against Kapa-Community Ministry International, Inc. in accordance with Section 5, subparagraph 5.1 (h) of Reoublic Act No. 8799, otherwise known as “The Securities Regulation Code,” bahagi pa rin ng resolusyon mula sa Minutes of the Commission Meeting na isinagawa ng SEC noong March 7, 2019.
Una rito, ibinasura ni Presiding Judge Joyce Kho Mirabueno ng Regional Trial Court (RTC) Branch 58 sa lungsod ng Heneral Santos, ang inihaing mosyon ng kampo ni Apolinario na humiling na magpalabas ng 72-hour-TRO laban sa inilabas ng SEC na CDO.
“Thus, we find that in the present petition, the Regional Trial Court of General Santos cannot properly issue a 72-hour-TRO to stop the implementation of a SEC Advisory (Annex A) and a SEC Cease and Desist Order (Annex B). WHEREFORE, premises considered, the prayer for the issuance of a 72-hour-TRO is DENIED. The Office of the Clerk of Court of the Regional Trial Court is directed to comply with the procedure in Section 5 of Rule 58 of the Rules of Court on Preliminary Injunction, and to serve a copy of this order upon petitioner, through counsel.â€
Sinabi na rin ng SEC noon pang nakalipas na taon sa kanilang advisory na ang religious group ay nag-o-operate sa iba’t ibang mga pangalan tulad ng KAPA Kabus Padatuon (Enrich the Poor), KAPA/ KAPPA (Kabus Padatuon), Kapaco Convenience Store and General Merchandise at KAPA Worldwide Ministry.
Sa naging ulat naman noon ng NBI ay kanilang natukoy na ang KAPA-Community ay nakakolekta na ng P7 million sa daan-daang mga investors na karamihan ay mga guro sa Bislig City, Surigao del Sur.
