Ibinasura ng Sandiganbayan ang P102-bilyong halaga ng forfeiture case laban sa mag-asawang sina dating Pangulong Ferdinand Marcos at first lady Imelda Marcos.

Batay sa 67-pahinang desisyon ng 2nd Division, sinabi ng anti-graft court na bigo ang Presidential Commission on Good Government (PCGG) na patunayang nag-extend ang mag-asawa ng loan accomodation sa iba’t-ibang kompanya ng bulk carrier: Aklan Bulk Carriers Inc., Fuga Bulk Carriers Inc., Coron Bulk Carriers Inc., and Ecija Bulk Carriers Inc.

Bukod dito hindi rin daw naipresenta ng PCGG ang mga ebidensyang nagpapatunay na binulsa ng mga Marcos at 11 kapwa akusado noon ang kita ng tatlong broadcast companies (RPN-9, IBC-13 and BBC-2); gayundin ang pagbuo umano ng mga ito ng isang offshore bank sa Amerika (California Overseas Bank).

“It saddens the Court that it took more than 30 years before this case is submitted for decision and yet, the prosecution failed to present sufficient evidence to sustain any of the causes of action against the remaining defendants,” nakasaad sa Sandiganbayan ruling na may petsang August 5, 2019.

“It is settled that in civil cases, the party making allegations has the burden of proving them by a preponderance of evidence. In addition, the parties must rely on the strength of their own evidence, not upon the weakness of the defense offered by their opponent.”

Ayon sa PCGG, tinatayang nasa $10-bilyon ang halaga ng nakaw na yaman ng pamilya Marcos, na idineposito umano sa mga bank accounts sa ibang bansa.

“Wherefore, premises considered, for failure of the plaintiff to prove by preponderance of evidence any of the causes of action against defendants Ferdinand E. Marcos, Imelda Marcos, Rafael Sison, Placido Mapa, Jr., Don M. Ferry, Jose R. Tengco, Jr., Ramon Monzon, Generosa C. Olazo, Cynthia Cheong, Ma. Luisa E. Nograles, Leopoldo Vergara, Jose L. Africa and Rodolfo Arambulo, the case against them is hereby dismissed.”
