Nilinaw ng Malacañang kay Mrs. Thelma Chiong, nanay ng rape-slay victims na sina Marijoy at Jacqueline na hindi sa administrasyon ni Pangulong Rodrigo Duterte naipasa ang Republic Act No. 10592 o ang Good Conduct Time Allowance (GCTA) Law.
Reaksyon ito ng Malacañang sa tinuran ni Mrs. Chiong sa Senate inquiry kahapon na anong nangyari sa GCTA Law ni Pangulong Rodrigo Duterte at napalaya ang mga convicted sa pagpatay at pag-rape sa kanyang mga anak.
Nilinaw ni Presidential Spokesman Salvador Panelo, ang nasabing batas ay nilagdaan ni dating Pangulong Benigno Aquino III noong 2013 kung saan si Rep. Sonny Belmonte ang House speaker at Sen. Juan Ponce Enrile ang Senate president.
Ayon kay Panelo, gaya ng nabulgar sa Senate hearing, nakagawian na ng Bureau of Corrections (BuCor) noong nakaraang administrasyon ang magpalaya ng mga preso dahil sa “good conduct” kahit pa convicted sa heinous crime.
Ang basehan ng nasabing hakbang ay Implementing Rules and Regulations (IRR) ng GCTA Law na binuo nina dating Justice Secretary na ngayon ay Sen. Leila De Lima at dating Interior and Local Government Sec. Mar Roxas II noong 2014 kung saan isinama ang mga convicted sa heinous crimes na kuwalipikado sa pag-avail ng benepisyo ng RA No. 10592.
“Cleary, the law and its IRR were prepared not by the officials of this Administration but by the previous one. The practice of granting GCTA to those convicted of heinous crimes has also been existent years before PRRD assumed his presidential seat. Meanwhile, the sudden increase in number of those purported to be eligible to avail of the benefits of GCTA was due to the recent ruling by the Supreme Court, a separate and independent branch of the government, which held that RA No. 10592 should be applied retroactively,” ani Sec. Panelo.
