Ibinasura ng Sandiganbayan ang panibagong hiling ni dating Sen. Jinggoy Estrada na nagpapabasura sa kanyang kasong plunder kaugnay ng pork barrel scam.
Batay sa desisyon ng 5th Division, sinabi ng anti-graft court na may sapat na ebidensyang magpapatunay para ituloy pa ng korte ang paglilitis sa dating senador.
Nag-ugat ang kaso ni Estrada matapos ang kwestyonableng paggamit nito noon ng kanyang Priority Development Assistance Fund (PDAF).
Batay sa imbestigasyon ng Ombudsman prosecutors, nasa P183-milyon ang halaga ng kickback ni Estrada matapos idaan sa pekeng non-government organizations ng convicted plunderer na si Janet Lim Napoles ang kanyang PDAF.
Una ng ibinasura ng korte ang hilig ng dating senador na hamunin ang mga ebidensya ng prosekusyon.
Para sa Sandiganbayan, si Estrada ang main plunderer sa kaso.
“This court maintains its position that the prosecution presented sufficient evidence to establish all elements of the crime charged,” ayon sa desisyon.
“It is clear that the main plunderer so to speak is no other than Estrada, having control over his PDAF and without his participation, the whole scheme would not have begun,” dagdag pa ng korte.
“Of all the accused in this case, the participation of Estrada is the most vital, as he served as the spark plug which ignited the complex PDAF scheme.”
