Ibinasura ng Court Appeals (CA) ang petisyon ng tatlong opisyal ng Bureau of Corrections (BuCor) na umalma sa pagkaka-detine nila noon sa Senado matapos ma-cite in contempt.
Batay sa tatlong pahinang resolusyon ng appellate court, sinabi ni Associate Justice Ramon Bato Jr. na wala ng dahilan para ituloy ang i-grant ang petisyon dahil pinalaya na rin ng Senado ang complainants.
Kung maaalala, naghain ng petition for habeas corpus sina BuCor medical officer Dr. Ursicio Cenas, Atty. Fredric Anthony Santos, at documents processing chief Ramoncito Roque dahil hindi umano patas at paglabag sa kanilang karapatan ang pagkakakulong nila sa Senate facility.
“In their comment dated Oct. 3, 2019, signed by Senate Legal Counsel Maria Valentina Santana-Cruz, respondents pointed out that the instant petition for habeas corpus had been rendered ‘moot and academic with the release of petitioners voluntarily by respondents on September 19, 2019, or even before the Honorable Court’s issuance of its Preliminary Citation on September 20, 2019.’ Accordingly, they prayed for the dismissal of the instant petition for being moot and academic, ayon sa korte.
Inabot ng walong araw ang detention ng tatlo matapos mag-desisyon ang mga miyembro ng Blue Ribbon Committee sa gitna ng pagdinig sa kontrobersyal na good conduct time allowance (GCTA) law.
Lumagda rin sa resolusyon sina CA 6th Division members Assoc. Justices Eduardo Peralta Jr. at Ruben Reynaldo Roxas.
