Humiling ngayon sa Sandiganbayan ang kampo ng tinaguriang “pork barrel queen” na si Janet Lim Napoles na hamunin ang ebidensya ng prosekusyon kaugnay ng kanyang kaso na plunder.
Batay sa 34-pahinang demurrer to evidence na inihain ng mga abogado ni Napoles sa 5th Division, kinuwestyon ng mga ito ang inilatag na mga ebidensya ng Office of the Ombudsman.
Iginiit kasi ng mga ito na hindi sapat ang mga ebidensya para idiin ang negosyante sa reklamo.
“The case is shrouded with serious doubts because the information suggests that accused Napoles, a private individual, is the main plunderer by alleging that the scheme enabled her ‘to misappropriate the PDAF proceeds for her personal gain.”
Para kay Napoles, ang kapwa akusado na si dating Sen. Jinggoy Estrada at former chief of staff nitong si Pauline Labayen ang dapat na ituring na main plunderer sa kaso dahil kapwa sila opisyal ng gobyerno.
Ito ay batay umano sa doktrina ng plunder case noon ni dating Pangulong Gloria Macapagal Arroyo kung saan naabswelto ito.
“To reiterate, what appears in the instant case is incompetent, inadmissible, and insufficient evidence that the conspiracy was geared towards helping accused Napoles misappropriate the PDAF proceeds for her personal gain.â€
“Thus, the pieces of evidence adduced by the prosecution are insufficient to prove plunder beyond reasonable doubt as they failed to point to any public officer as the main plunderer.”
Bukod sa mga ebidensya, kinuwestyon din ng mga abogado ni Napoles ang salaysay ng whistleblower na si Benhur Luy.
“Mr. Benhur Luy is a self-confessed forger. And there is no dispute that a forger is a dishonest person,†ani Atty. Erwin Legaspi.
Kung maaalala, nauna ng naghain ng kanyang demurrer si Estrada sa anti-graft court.
