Nilinaw naman ni PNP OIC Lt Gen Archie Gamboa na ang mga maaaresto sa gagawing nationwide crackdown sa paggamit ng electronic cigarettes o Vapes sa mga pampublikong lugar ay hindi makukulong subalit dadalhin pa rin ito sa presinto at iba blotter.
Ayon kay Gamboa ang basehan na kanilang pag aresto ay ang Executive Order 26 o ang local ordinances gayong may hawig ito sa smoking ban.
“We are just exercising police power of protecting public interest which is public health. Alam nyo kasi ang sinasabi kasi natin dito even on decisions of the supreme court they say there is a hierarchy of rights. Prime among those are those that which concerns national interest, public health, national security and all those things that’s why individual rightssomes in second or third kaya nga yung pinoproteksyunan natin, yung higher interest. Kung makita nyo sa EO yun ang unang whereas clause,” paliwanag ni Gamboa.
Aniya, kanila lamang pinapatupad ang police power ang protektahan ang interes ng publiko partikular ang public health.
” You know what blotter, it doesn’t even have a probative value. You cannot even use that it court and You cannot prejudice a person later on kasi ang blotter naman you he gesthere alleges his own version. This is just for protecting public interest which is public health. Doon lang tayo,” dagdag pa ni Gamboa.
Tiniyak naman ni Gamboa na walang paglabag sa karapatang pantao sa gagawing pag aresto sa mga mahuhuling gumagamit ng vape.
” We assure that there will be no abuses. If there is tell me,” wika ni Gamboa.
Panawagan ni Gamboa sa publiko na huwag na silang i challenge pa at huwag ng gumamit ng vape.
” Ang premise kasi natin talaga is public health. Alam mo naman we are trying to protect the public health tapos alam mo na ginagamit yung vape. Sinabi ng presidente na bawal yan, to discourage lang naman. Ang suggestion ko nga huwag nyo na kaming ichallenge. Very simple lang naman huwag na tayo gumamit ng vape. If you want to use vape, use it in private places, not in public places. Yun lang,” giit ni PNP OIC.
Sa ngayon naka antabay ang PNP sa ilalabas na executive order ng Pangulong Rodrigo Duterte hinggil sa paggamit ng vape.
