Former Magdalo Rep. Gary Alejano urged the Court of Appeals (CA) to stop the Department of Justice (DoJ) on conducting a preliminary investigation over the sedition case filed by PMP-Criminal Investigation and Detection (CIDG).

Alejano, together with Jonnell Sangalang of Magdalo, filed a petition for Prohibition before CA and reiterated that justice department has no authority to conduct the preliminary probe.

“The appeal emphasized that it is clear under the Prosecution Service Act that the Secretary of Justice has no power to act directly on a complaint which does not involve any crime against national security,” the statement read.

They also requested to appeals court to stop the Office of the Solicitor General (OSG) from acting as the lawyer of PNP-CIDG.

Citing Presidential Decree 478 and the Administrative Code, “It’s obvious that this administration is using these two agencies for political persecution, to bully its critics, in deliberate deviance of the Prosecution Service Act, P.D. 478 and the Administrative Code,” Alejano said in a statement.

Alejano and Sangalang were among the 35 respondents in the criminal complaint of sedition or inciting to sedition, cyber liber, liber, estafa and harboring a criminal or obstruction of justice filed by PNP-CIDG linking to their alleged role in making and spreading the “Ang Totoong Narcolist videos” to oust President Rodrigo Durterte.
